Jerusalem: Principles of Peacemaking Within The 
Republic of New Lemuria

 

Introduction: 

On October 17, 1997, the Republic of New Lemuria by Notice of Accession, acceded to the Hague Convention I for Pacific Settlement of International Disputes (1898-89) [UKTS 9 (1901) Cd. 798] and the Hague Convention for Pacific Settlement of International Disputes (1907) [UKTS 6 (1971 Cmnd. 4575]. Copies of these Notices of Accession may be obtained directly upon written E mail request to the RNLPCA. The Republic of New Lemuria Permanent Court of Arbitration is patterned after the Permanent Court of Arbitration located at the Hague which is described as follows:

A brief description of The Permanent Court of Arbitration at Peace Palace, The Hague follows immediately. In general terms the Republic of New Lemuria Permanent Court of Arbitration ("RNLPCA") is modeled after the Hague Permanent Court of Arbitration, with additions as indicated in the text below. All awards rendered by the RNLPCA are enforceable under the Convention on Recognition of Foreign Arbitral Awards done at New York on 10 June 1958. To the extent not inconsistent with the revealed Divine Law, the RNLPCA applies the UNIDROIT Principles of International Contracts [Latest 1994 edition as amended] to all arbitrations and mediations when the circumstances require. A copy of the UNIDROIT principles is found in the Appendix.


THE PERMANENT COURT OF ARBITRATION:

What it is and What it Does

The Hague Permanent Court of Arbitration is:

  • The oldest institution for the settlement of disputes between States (or organizations of States), and disputes between States and private parties. Its services include good offices and mediation, commissions of inquiry (fact-finding), conciliation, and arbitration.

  • An independent international organization established by the Convention for the Pacific Settlement of International Disputes (The Hague, July 29, 1899), which was revised by a second Convention for the Pacific Settlement of International Disputes (The Hague, October 18, 1907).

  • A secretariat, the International Bureau, located in the Peace Palace, constructed in 1913 to serve as headquarters 
    of the PCA, which is also home to the International Court of Justice and the Hague Academy of International Law.

  • A Permanent Observer at the United Nations General Assembly, with a strong history of collaboration with the UN.

  • A panel of international jurists, known as the Members of the Court, designated by the States Parties to the 1899 and 1907 Conventions. Parties to a dispute may, but are not required to, select the members of a tribunal or commission from this panel. An up-to-date list of Members is published in the Annual Report of the PCA.

  • An Administrative Council, composed of the diplomatic representatives of the States Parties.

What The Hague Permanent Court of Arbitration Does:

  • Offers a broad range of services for the resolution of disputes in which at least one party is a State (or an organization of States), and which the parties have expressly agreed to submit for resolution under the auspices of the Permanent Court of Arbitration, either by signing a submission after a dispute has arisen, or by including a "future disputes" clause in a treaty, contract or other type of agreement.

  • Designates, pursuant to the 1976 rules on international commercial arbitration adopted by the United Nations Commission on International Trade Law (UNCITRAL) "appointing authorities" to break certain deadlocks that may arise in connection with the appointment and challenge of arbitrators in commercial arbitration conducted under the UNCITRAL Arbitration Rules.

  • Administers dispute settlement, including arbitration, conciliation, mediation, good offices, and commissions of inquiry (fact-finding).

  • Provides facilities for selecting members of tribunals and commissions, from a panel of over 250 international jurists of various nationalities (the Members of the Court), or persons of their own choice.

  • Allows the parties freedom to choose procedural rules, from among:

  • the rules of the 1899 Convention or 1907 Convention;

  • the PCA Optional Rules for:

  • other appropriate rules, such as the UNCITRAL Arbitration Rules, the Conciliation Rules, the London Court of International Arbitration (LCIA) Rules, and the World Intellectual Property Organization (WIPO) Rules.

  • Provides administrative support: the International Bureau can relieve the parties and the tribunal or commission of the administrative burden of resolving the dispute by acting as registry: serving as the official channel of communication, holding and disbursing deposits for costs, ensuring safe custody of documents, arranging for hearings and meetings, and for efficient secretarial, language and communications services.

  • Makes available a distinctive courtroom, other types of hearing and meeting facilities, separate counsel rooms, and deliberation rooms.

  • Has access to the Peace Palace library: one of the most comprehensive and up-to-date international law libraries in the world.

  • Maintains facilities for conducting proceedings outside The Hague, with the administrative support of the International Bureau and, where necessary, the assistance of a local tribunal registrar.

  • Charges reasonable fees: the expenses of operating the PCA are borne by the States Parties. Parties to a dispute pay only those costs incurred in connection with their own case.

  • Maintains a Financial Assistance Fund, aimed at helping developing countries meet the cost of dispute resolution proceedings.

  • Offers information and advice to prospective parties, even if the governments of the State(s) concerned are not parties to the 1899 or 1907 Conventions.

  • Allows ease of accession, which is accomplished by depositing the requisite documents with the Netherlands' Ministry of Foreign Affairs. States are actively encouraged to accede, in order to strengthen the PCA and ensure that the largest possible number of States participate in determining its future course.

How Does the Republic of New Lemuria Permanent

Court of Arbitration (RNLPCA) provide for alternative dispute

resolution along the guidelines of the Hague Permanent Court

Of Arbitration? What are the differences, if any?

 

The Republic of New Lemuria Permanent Court of Arbitration (RNLPCA) comprises an intergovernmental organization (IGO). International Governmental Organizations (IGOs) are organizations to which only governments, not individuals, belong. These organizations attempt to regulate, set standards for, and promote cooperation among governments in a variety of areas.  Almost any sphere in which two or more governments interact has an associated IGO.  Well known IGOs  include the United Nations, European Union, Organization for Economic Cooperation and Development (OECD), OPEC, International Labour Organization, International Social Security Association, International Union for the Conservation of Nature and Natural Resources, the Universal Postal Union and the World Health Organization, and arbitration forums known as the Permanent Court of Arbitaration, UNIDROIT, UNICITRAL and LCIA (London Court of International Abritration). The RNLPCA differs from the Hague PCA in the following two significant ways:

The process of dispute settlement, by way of mediation or arbitration involves choices. When disputing parties embark upon the path of dispute resolution, each must first deal with the choice of whether or not to seek peace. Today, when one observes traditional arbitration and mediation proceedings, it appears it is more important to the disputants to win at all costs rather than seek peace through conciliation and understanding. The Republic of New Lemuria Permanent Court of Arbitration is established in order to provide a meaningful choice and forum for dispute resolution to people, organizations [whether NGO's or IGO's], nations and other bodies politic. Those who choose to use the Republic of New Lemuria Permanent Court of Arbitration are required to read this document entitled: "Jerusalem: Principles of Peacemaking Within the Republic of New Lemuria" before filing their "Notice of Intent to Mediate" or "Notice of Intent to Arbitrate." This is a mandatory requirement, because the scriptural principles contained herein are conciliation tools which are used throughout the arbitration and mediation peace processes.

 

Part of the mission of the Republic of New Lemuria Permanent Court of Arbitration uniquely involves the publishing and distribution of Biblical principles which foster peacemaking and peacekeeping in the every day affairs of all peoples. Historically, this was Melchizedek's function as the King of Salem symbolized by his use of bread and wine with Abraham. This ancient tradition of eating bread and serving wine during the peace process remains alive within the Republic of New Lemuria peace processes.

 

"All that is known historically of Melchzedek is contained in the Bible, in Genesis 4:18, Psalms 110 and Hebrews 5:5,7. The incident which connects him with history is the story of Abraham, returning to his own country with the spoils captured from Chedorlaomer who was battling with Lot, his sons and tribe and whom Abraham sought to rescue, gave tithes to his superior functionary, Melchizedek, high priest of righteousness and king of Salem, city of peace. It relates how this distinguished priest of the most high God refreshed Abraham with bread and wine and bestowed upon him is blessing, making him a priest of his own order."1

 

The "revealed Divine law "is a phrase continually referred to in the law of the Republic of New Lemuria, and forms the foundation for all dispute resolution within the Republic of New Lemuria Permanent Court of Arbitration structure. The "revealed Divine law" has two components.

 

The first component is the Seven Noahide Laws signifying the ancient principles of law given by the Most High God El Elyon to Noah and recognized by United States' President George W. Bush in 1991:

 

". . . these ethical values and principles have been the bedrock of society from the dawn of civilization, when they were known as the Seven Noahide Laws." -- U.S. Congress (H.J. Resolution 104, Public Law 102-14, 1991)

 

Melchizedek stated and taught 1,973 years before the birth of My Lord Jesus, the Christ, "I am Melchizedek, priest of El Elyon, the Most High, the one and only God." The Seven Laws (described as "Noahide Laws" in the ancient Dalamatian supreme law) are commandments promulgated by Melchizedek (known as the Melchizedek covenant)2, adopted by ourPatriarch Abraham, found engraved upon clay tablets in Salem comprising:

1. You shall not serve any God but the Most High Creator of heaven and earth.

2. You shall not doubt that faith is the only requirement for eternal salvation.

3. You shall not bear false witness.

4. You shall not kill.

5. You shall not steal.

6. You shall not commit adultery.

7. You shall not show disrespect for your parents or elders.

 

In Rabbi Yirmeyahu Bindman's book on the Seven Noahide Laws entitled "The Seven Colors of the Rainbow" (Resource Publications, Inc., San Jose California, 1995, ISBN 0-89390-332-9, pp. 114-117) is found:

 

"Most of today's governments are considered to be upholding this commandment on a basic level, even though they hardly know of the Seven Laws, because their inner motivation is to do what God wants in this way. However, when justice becomes so corrupt that this commandment no longer has any standing in society, or when the legal system gives punishments for actions that are legal under the Seven Laws, then the situation enters into constitutional illegality. Societies are legitimate targets for thorough change, and those who rule them may be defeated and put on trial. Such governments abuse the trust placed in them as emissaries of the Almighty, and they make themselves liable to be judged. . . Even in republican states, the judges sit only in the name of the true sovereign power, however it is defined . . . The judge who hears a case fully and decides it impartially, is considered a partner with God Himself in the entire creation because he is using the sovereign authority with which the creation was made.

 

The second component of the revealed Divine Law signifies that which was symbolized in the writing of the imminent jurist Sir William Blackstone:

 

"Considering the creator only as being of infinite power, he was able unquestionably to have prescribed whatever laws he pleased to his creature, man, however unjust or severe. But as he is also a being of infinite wisdom, he has laid down only such laws as were founded in those relations of justice, that existed in the nature of things antecedent to any positive precept. These are eternal, immutable laws of good and evil, to which the creator himself in all his dispensations conforms; and which he has enabled human reason to discover, so far as they are necessary for the conduct of human actions. Such among others are these principles: that we should live honestly, should hurt nobody, and should render to every one his due; to which the three general precepts Justinian has reduced the whole doctrine of law. [Juris praecepta, sunt haec, honeste vivere, alterum non laedere, suum cique tribuere.]…

 

This law of nature, being co-eval with mankind and dictated by God himself, is of course superior in obligation to any other. It is binding all over the globe, in all countries, and at all times: no human laws are of any validity, if contrary to this; and such of them as derive their force, and all their authority, mediately or immediately, from this original. . .

 

The doctrines thus delivered we call the revealed or divine law, and they are to be found only in the holy scriptures. These precepts, when revealed, are found upon comparison to be really a part of the original law of nature, as they tend in all their consequences to man’s felicity. But we are not from then to conclude that the knowledge of these truths was attainable by man’s reason, in its present corrupted state; since we find that, until they were revealed, they were hid from the wisdom of the ages. As then the moral precepts of this law are indeed of the same original with those of the law of nature, so their intrinsic obligation is of equal strength and perpetuity. Yet undoubtedly the revealed law is (humanly speaking) of infinitely more authority than what we generally call the natural law. Because one is the law of nature, expressly declared so to be by God himself; the other is only what, by the assistance of human reason, we imagine to be that law. If we would be certain of the latter as we are of the former, both would have equal authority; but, till then, they can never be put in competition together.

 

Upon these two foundations, the law of nature and the law of revelation, depend all human law; that is to say, no human laws should be suffered to contradict these. There is, it is true, a great number of indifferent points, in which both the divine law and the natural law leave man at his own liberty; but which are found necessary for the benefit of society to be restrained within certain limits. And herein it is that human laws have their greatest force and efficacy; for, with regard to such points as are not indifferent, human laws are only declaratory of, and act in subordination to the former. To instance in the case of murder: this is expressly forbidden by the divine, and demonstrably by natural law; and from these prohibitions arises the true unlawfulness of this crime. Those human laws, that annex a punishment to it, do not increase it’s moral guilt, or superadd any fresh obligation in foro conscientiae to abstain it’s perpetration. Nay, if any human law should allow or injoin us to commit it, we are bound to transgress that human law, or else we must offend both the natural and the divine. But with regard to matters that are themselves indifferent, and are not commanded or forbidden by those superior laws; such for instance, as exporting wool into foreign counties; here the inferior legislature has scope and opportunity to interpose, and make that action unlawful which before was not so." 1 Blackstone’s Commentaries 40-42.

 

Application of the Revealed Divine Law

to All Mediation and Arbitration Proceedings.

 

Both of the components of the revealed Divine law above described are applied by the chosen mediators and arbitrators, without exception, to all mediations and arbitrations conducted within the Republic of New Lemuria Permanent Court of Arbitration. In addition, each mediator and arbitrator handling a proceeding within the Republic of New Lemuria Permanent Court of Arbitration is continually admonished to apply the principles of peacemaking and peacekeeping ["walking in the ways of the Lord"] found within the spirit of the scriptural passages set out below:

The Biblical Tradition of Peace Is

A Common Perspective Signifying

In Our Every Deliberation,

Maintaining the Vision of Peace - Jerusalem.

 

There is an ancient desert wisdom tradition (common to Judaic, Christian and Islamic cultures) of establishing, maintaining and living "peace" with a "greeting" [Aramaic shalama, Hebrew shalom] found throughout all the periods described in both the Old and New Testaments of the Bible. The principle of "peacemaking" and "peacekeeping" as paramount states of mind and being form the foundation of Jerusalem spoken of by the Judean philosopher Philo:

 

"Now the city of God is called in Hebrew Jerusalem and its name when translated is 'vision of peace'. Therefore, do not seek the city of the Existent among the regions of the earth, since it is not wrought of wood or stone, but in a soul, in which there is no warring, whose sight is keen, and which is set before it as its aim to live in contemplation and peace."

 

In the Book of Legends/Sefer Ha-Aggadah, a compendium of rabbinic lore, first published in Odessa in 1908-1911, peace is described as one of three pillars of the foundation of the world:

 

"128. Rabban Simeon ben Gamiel said: 'The world stands on three things: on truth, on justice, and peace within your gates' (Zech. 8:16). These three are interlinked: when justice is done, truth is achieved, and peace is established. [Avot 1:18; P.Ta 4:2, 68a]. 129. Rabban Simeon ben Gamiel said: Make no mockery of justice, for it is one of the world's three pillars. How so? Because the sages have taught: The world stands on three things: on justice, on truth, and on peace. Take care not to subvert justice, you shake the world, one of whose pillars is justice. [Deut. R. 5:1; Kalkut, Shofetim, Section 907]."

In the Quran (xv.45-49) we read:

 

"Lo! The God-fearing are among gardens and watersprings.

'enter them in peace, secure'

And We remove whatever burning venom may be in their breasts. As brethren,

Face to face, they rest on couches raised.

Toil cometh not unto them there, nor will they be expelled from thence.

Announce unto My slaves that verily I am the Forgiving, the Merciful."

 

Consistently, in the New Testament we read the words of Lord Jesus the Christ from the Sermon on the Mount (Aramaic, then English):

 

Tubwayhun lahwvday shlama dawnaw(hie) d'alaha nitqarum.

Blessed are the peacemakers: for they shall be called the children of God.

 

 

Biblical scholar George M. Lamsa in the book Old Testament Light [Harper San Francisco, (1964) p. 168-169 ISBN 0-06-064925-9] speaks of the "peace" referred to in Leviticus 3:1 ["And if his oblation be a sacrifice of peace offering, if he offer it of the herd, whether it be a male or a female, he shall offer it without blemish before the Lord"]. He reminds us:

 

"The Aramaic word shalma, to 'recompense,' to 'fulfill one's vows,' is written exactly like the word shalama, 'peace'. Even though the words are identical, they are pronounced differently. A recompense offering is a thanks offering to God for his blessings, or for his favours. When Jacob was on his way to Haran, he made a vow in which he vowed to give a tithe to God [Genesis 28:20-22].

 

Shalama, 'peace,' also means to surrender; that is, to give up to hatred and enmity, and become reconciled. Peace becomes a reality through recompense, which brings harmony between a man and his adversary.

The worshipper was required to make peace with his God and his fellow men. Jesus said, 'Leave your offering there upon the altar, and first go and make peace with your brother . . .' [Matthrew 5:24, Eastern text]. If one has to make peace with his brother before offering a gift upon the altar, how much more then is it necessary that he should make reconciliation with God.

The recompense of the peace offering is different from the sin offering, thanks offering, and other offerings. Even though all these offerings were made to God for the forgiveness of sins and for God's blessings, each one was offered for a special thing, or for a special favour from God. There were also some differences in the ritual. Each offering had its own ritual."

 

Dr. Lamsa provides an additional insight on the need for peace in his discussion of Job 6:14: "He who withholds peace from his friend, forsakes the worship of the Almighty." "The Aramaic word dikhlety means 'worship, reverence, fear'. In this instance it means 'worship.' Worship without peace and good deeds is dead, as faith without works is dead. Peace always reigns in the house of the righteous. Peace, like light, must be shared in order to lighten the path of those who seek the way of God. The Hebrew prophets exhorted the people to extend kindness one to another -- to strangers and to widows and orphans. Jesus said: 'For I was hungry, and you gave me food: I was thirsty, and you gave me drink; I was a stranger and you took me in' [Matthew 25:35, Eastern text]"

Finally, in discussing peace Dr. Lamsa focuses upon the true understanding (Islamic, Christian and Judaic alike) of 'peace' as "I surrender to you" in his treatment of Isaiah 57:19: "I create the speech of the lips; peace, peace to those who are afar off and to those who are near, says the LORD; and I will heal them." Dr. Lamsa states:

"'Peace' is a key word that is constantly used in daily conversation and which introduces two strangers to one another. Whenever two Easterners meet, they greet one another by the same words, 'To you be peace.' When the magic words of peace are offered and received, the strangers become close neighbors, or even brothers. This greeting of peace established confidence and good relations between two strangers.

The term shallam (peace) means 'I surrender to you.' When two strangers surrender to one another, they surrender to God. God had been wroth with Israel, but he was to return to them again and heal them and revive the heart of the contrite ones so that they could make peace with their God. Political and stubborn Israel was crushed. The spiritual Israel, or the remnant, was to be blessed so that they might bless the world."

The collection of scriptural passages which follow portray a bright line path of peace, consistently preached and lived by those in Covenant with the Most High God holding the vision of "Jerusalem". This peace is a gift from God to each of His children. In his image each of us is made. Our responsibility is to reflect this peace during our entire lives.

 

Biblical Verses of Peacemaking - Old Testament:
